Abstract

This article examines the role of the Constitutional Court in enforcing presidentialism principle in Indonesia. This article argues that while the Constitutional Court does not agree with the legislative policy to decrease the number of political parties, it strongly supports the principle that presidentialism should prevail over political contestation. This argument resulted from the analysis of the Constitutional Court’s case-law in reviewing the constitutionality of legislation. The Constitutional Court’s effort to upheld the presidentialism principle can be seen from the electoral threshold case, parliamentary threshold cases, presidential election case, and presidential threshold case. The main issue of the cases raises the need for political party system reform compatible with the presidential system as a constitutional principle in Indonesia.
