REINFORCING PRIMARY LEGAL EDUCATION IN THE DEVELOPMENT OF ELECTRONIC LEGISLATION

The use of artificial intelligence in electronic legislative norms during the legislative process is beginning to be conceptualized and shows increasing potential for application. One aspect that has received insufficient attention is the relationship between legal education and the legal system: the reinforcement of primary legal science, the creation of new primary legal science, or the development of new secondary legal science. This article argues that the development of legislative science and legislative drafting practice, as a mandate of an extra-legal approach, must accompany the advancement of electronic legislation, grounded in more substantive learning as the primary legal science, without positioning artificial intelligence as a new secondary legal science. This prescription develops through two layers of legal principles: first, the primary aspect of legal science, under a “back to basics” thesis; second, legal education must reaffirm the legal system as the foundation for the creation of legal norms.
