LEGISLATIVE TERM LIMITS FROM THE PERSPECTIVE OF CONSTITUTIONALISM

This study examines the urgency of imposing term limits on members of the legislature from the perspective of constitutionalism, particularly in light of the principle of limiting power. In contrast to the executive branch, which is already subject to term limits, the legislative branch in Indonesia has no such restriction. Article 76, paragraph (4), of Law Number 17 of 2014 stipulates only a five-year term of office, without limiting the number of terms. This research employs a normative juridical method, drawing on statutory, conceptual, and comparative approaches. The findings indicate that the absence of term limits can encourage the concentration of power and hinder political regeneration. In several countries, legislative term limits are increasingly seen as part of efforts to strengthen accountability. This study argues that legislative term limits can serve as an instrument to reinforce the principles of constitutionalism and promote a more balanced democratic system. Academically, this research contributes to expanding the discourse on the limitation of power by situating it not only within the executive branch but also within the legislature.
