KARAKTER ILMU HUKUM: PENDEKATAN FUNGSIONAL DALAM KAITAN DENGAN PENDIDIKAN HUKUM

Abstract

Tulisan ini membahas isu tentang karakter Ilmu Hukum (Jurisprudence) dalam kaitan dengan pendidikan hukum dengan menggunakan pendekatan fungsional. Tulisan ini berargumen bahwa Ilmu Hukum harus fungsional dengan pendidikan hukum. Oleh karena itu, hakikat dari pendidikan hukum harus diklarifikasi terlebih dahulu sehingga konsep Ilmu Hukum dapat dimaknai secara tepat. Lebih lanjut, tulisan ini menjelaskan tentang level atau tingkatan berpikir dalam Ilmu Hukum, sehingga konsep Ilmu Hukum dapat dibedakan, berdasarkan tingkatan berpikirnya, menjadi Dogmatika Hukum (Legal Dogmatics), Teori Hukum (Legal Theory) dan Filsafat Hukum (Legal Philosophy). Ketiga disiplin tersebut harus konsisten dalam mendukung jalannya pendidikan hukum.

This paper discusses the issue concerning the character of Jurisprudence in relation to legal education. By applying functional approach, it is argued that Jurisprudence must functionally support legal education. Therefore, the nature of legal education should be clarified in advance to enable the development of a proper concept of Jurisprudence. Additionally, this paper also describes the various level of thinking in Jurisprudence, which conceptually distinguish Jurisprudence into Legal Dogmatics, Legal Theory and Legal Philosophy. These three disciplines must be consistent in supporting the course of legal education.
